Uitspraak Diarra-rechtszaak: enkele transferregels FIFA in strijd met EU-wetgeving.
Enkele FIFA-regels rondom contracten en transfers in het voetbal zijn in strijd met wetgeving in de Europese Unie. Dat heeft het Europese Hof van Justitie vrijdagochtend gezegd in een uitspraak over de zaak rond oud-voetballer Lassana Diara en de FIFA.
“De regels in kwestie belemmeren het vrije verkeer (binnen de EU, red.) van profvoetballers die hun carrière willen voortzetten door bij een nieuwe club te gaan werken”, lichtte rechters in Luxemburg toe in een verklaring.
De zaak-Diarra speelt al sinds 2014 en belandde na jaren van procedures via de Belgische rechtbank bij het EU-hof. De zaak draait om een geschil tussen de Franse oud-voetballer Diarra en wereldvoetbalbond FIFA die, volgens de voetballer, hem verhinderd zou hebben om bij een nieuwe club aan de slag te gaan nadat zijn contract met zijn oude club was beëindigd.
De FIFA zal door de uitspraak de regels over de contracten van profvoetballers, althans in Europa, wellicht moeten aanpassen. Wat de exacte consequenties voor het transfersysteem in Europa zullen zijn, is nog onduidelijk.
